Acceptable Use Policy
This Acceptable Use Policy ("AUP") governs the use of the Omnovo platform and related services (the "Services") provided by Bluegrass Digital Advantage LLC ("Omnovo," "we," or "us"). This AUP is incorporated into and forms part of the Omnovo Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.
By using the Services, you agree to comply with this AUP. Omnovo may update this AUP from time to time; material changes will be communicated by updating the "Last updated" date and, where appropriate, by email to the account contact. Continued use of the Services after such an update constitutes acceptance of the updated AUP.
1. Prohibited Content
You may not use the Services to create, store, transmit, display, or distribute any content that:
- Is illegal under applicable federal, state, or local law, including content that promotes or facilitates illegal activity.
- Is harmful, threatening, abusive, harassing, tortious, or constitutes hate speech, or promotes violence against any individual or group.
- Is defamatory, libelous, or fraudulent, or contains material misrepresentations of fact.
- Infringes any patent, trademark, trade secret, copyright, or other intellectual property or proprietary right of any party.
- Constitutes unsolicited bulk email, spam, chain letters, pyramid schemes, or any form of unauthorized commercial solicitation.
- Contains malware, viruses, trojan horses, worms, ransomware, spyware, or any other malicious or destructive code.
- Contains or distributes child sexual abuse material (CSAM), or exploits or endangers minors in any way.
- Violates any person's right to privacy or publicity, or collects personal information without required consent.
2. Prohibited Activities
You may not engage in any of the following activities in connection with the Services:
- Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, algorithms, or underlying structure of the Services or any component thereof.
- Gaining or attempting to gain unauthorized access to the Services, other accounts, computer systems, or networks connected to the Services, whether through password mining, brute force, social engineering, or any other means.
- Scraping, crawling, or using any automated means to access the Services or extract data from the Services, except through APIs and features explicitly provided for that purpose.
- Conducting or launching denial-of-service (DoS or DDoS) attacks, flooding, mail-bombing, or any other activity designed to disrupt or degrade the performance of the Services or the experience of other users.
- Circumventing, disabling, or interfering with any security, authentication, rate limiting, or access control features of the Services.
- Using the Services to operate a competing product or service, or to benchmark the Services for competitive purposes without written consent.
- Reselling, sublicensing, or redistributing access to the Services except as expressly permitted by your subscription plan.
- Impersonating Omnovo, another user, or any other person or entity, or falsely representing your affiliation with any person or entity.
3. Platform-Specific Rules
The Services integrate with third-party platforms including but not limited to Facebook, Instagram, Google Business Profile, LinkedIn, X (Twitter), Yelp, and other review and social media platforms (collectively, "Connected Platforms"). When using the Services to publish content to or interact with Connected Platforms, you must also comply with the following:
- No fake reviews. You may not use the Services to create, solicit, or publish fake, fabricated, or incentivized reviews on any Connected Platform. All reviews published through the Services must reflect genuine customer experiences.
- No misleading business information. Business name, address, phone number, service area, licensing, insurance, and other business details published through the Services must be accurate and current. You may not misrepresent your qualifications, credentials, or service capabilities.
- No impersonation. You may not use the Services to impersonate another business, individual, or organization on any Connected Platform.
- Connected Platform compliance. You are responsible for complying with the terms of service, community guidelines, advertising policies, and content policies of each Connected Platform you use through the Services. Omnovo is not responsible for enforcement actions taken by Connected Platforms against your accounts.
- OAuth and access authorization. You may only connect accounts to the Services that you are authorized to manage. You may not connect accounts belonging to others without their explicit authorization.
4. AI Content Guidelines
The Services use artificial intelligence to generate content including but not limited to website copy, social media posts, review replies, and analytics reports. When using AI-generated content produced through the Services:
- No deceptive use. You may not use AI-generated content to deceive consumers, fabricate testimonials, or create false endorsements. AI-generated content must be reviewed for accuracy before publication.
- No automated mass publishing without review. You may not bypass or disable the approval workflow to mass-publish AI-generated content without human review. The Services include an approval step for a reason — use it.
- Platform AI content policies. You are responsible for complying with each Connected Platform's policies regarding AI-generated content, including disclosure requirements where applicable.
- Accuracy responsibility. While Omnovo strives for accuracy in AI-generated content, you are ultimately responsible for verifying that content published under your business name is truthful and accurate. Review all AI-generated content before approving it for publication.
5. Enforcement and Consequences
Omnovo reserves the right to investigate suspected violations of this AUP and to take appropriate action, which may include the following escalation steps depending on the severity, frequency, and nature of the violation:
5.1 Warning
For first-time or minor violations, Omnovo may issue a written warning identifying the violation and requesting corrective action within a specified time period.
5.2 Suspension
For repeated violations, failure to correct a warned violation, or violations of moderate severity, Omnovo may suspend access to all or part of the Services. During suspension, your data remains stored but inaccessible until the matter is resolved.
5.3 Termination
For severe violations, including but not limited to illegal activity, malware distribution, CSAM, or deliberate and repeated abuse, Omnovo may terminate your account immediately without prior warning. Where permitted by law, Omnovo may also report the activity to appropriate law enforcement authorities.
Omnovo will use reasonable judgment in applying enforcement actions and will consider the totality of the circumstances. However, Omnovo is under no obligation to provide advance notice or a hearing before taking action to protect the Services, other customers, or third parties.
6. Reporting Violations
If you believe that a user of the Services is violating this AUP, please report the violation to abuse@omnovo.com. Include as much detail as possible, including the nature of the violation, the content or activity in question, and any supporting evidence. Omnovo will review all reports and take appropriate action, but is not obligated to disclose the outcome of any investigation.
7. Governing Law
This AUP is governed by the laws of the Commonwealth of Kentucky, USA, without regard to its conflict of laws principles.
